An Amendment to Regulations of Trademark Fees Partially Announced on December 27, 2010 and Will Enforce on February 1, 2011

The TIPO indicated that the appropriate adjustment of fees for trademark applications is on the grounds of the reasonable response to examining costs, improving efficiency of trademark examination and feasibility of practices; and the fee for a renewal application could be refunded to avoid disputes by considering said fee is for the maintenance of rights. Therefore, the partial amendment of Regulations of Trademark Fees will enforce on February 1, 2011. The principle contents of the amendment are as follows:Â

(1) For Classes 1 to 34, an application of a trademark or collective trademark for goods involving not more than 20 terms in one class is NT$3,000. If more than 20 terms are involved in one class, an official fee NT$200 will be charged for each additional term.
(2) For Classes 35 to 45, an application of a trademark or collective trademark in one class is NT$3,000. However, if more than 5 terms are involved in Class 35 for retailing services of specific goods, an official fee NT$500 will be charged for each additional term.
(3) If a withdrawal of renewal application is filed before the approval is granted by the TIPO, the official fee could be refunded.

Since the amendment of Regulations of Trademark Fees will influence the costs of filing new trademark applications in Taiwan, trademark holders should pay more attention to these situations.
